    Who is subject to the EU AI Act?

    The EU AI Act applies to every organisation in the AI value chain.

    The world's first comprehensive AI regulation covers providers, deployers, importers, and distributors, regardless of where they are based, if their AI systems affect EU residents.

    AI Providers

    Organisations that develop or place AI systems on the EU market, including non-EU companies. Highest obligation tier: conformity assessments, technical documentation, and risk management systems.

    AI Deployers

    Organisations that use or implement AI systems within their operations. Must conduct fundamental rights impact assessments (FRIAs) for high-risk systems and maintain human oversight protocols.

    AI Importers

    Companies that bring AI systems from non-EU providers into the European market. Must verify provider compliance, ensure proper CE marking, and maintain traceability documentation.

    AI Distributors

    Any entity making AI systems available on the EU market. Required to verify all upstream compliance requirements are met before distribution and must ensure proper labelling.

    Risk-based classification framework

    Prohibited

    Banned AI practices

    AI systems posing unacceptable risk to fundamental rights. Enforceable since February 2, 2025. Fines up to €35M or 7% of global turnover.

    Examples: Social scoring, real-time biometric ID in public spaces, manipulative subliminal techniques, exploitation of vulnerabilities

    High-risk

    Strict obligations

    High-risk systems must meet comprehensive requirements. Key deadline: December 2, 2027. Requires conformity assessments and ongoing monitoring.

    Examples: Credit scoring, hiring & HR decisions, medical diagnosis, critical infrastructure, education access, law enforcement

    Limited-risk

    Transparency required

    AI systems interacting with people must disclose their AI nature. Users must know when they are interacting with an AI system.

    Examples: Chatbots, emotion recognition systems, deepfake generators, AI-generated content requiring disclosure

    Minimal-risk

    No specific obligations

    The majority of AI systems fall here. No mandatory requirements, though voluntary codes of conduct are encouraged.

    Examples: Spam filters, AI-enhanced video games, inventory management, weather forecasting, recommendation engines

    GPAI model obligations

    General-purpose AI model providers must comply with transparency and safety requirements, including technical documentation and systemic risk assessments.

    Dec 2, 2027 · Key deadline

    High-risk AI systems (stand-alone)

    Obligations for stand-alone high-risk AI systems apply, deferred from August 2026 under the Digital Omnibus agreement: conformity assessments, technical documentation, risk management, human oversight, and EU database registration. Rules can apply earlier once the Commission confirms harmonised standards are available.

    High-risk AI embedded in products

    Obligations apply to high-risk AI systems embedded in products regulated under existing EU product safety legislation, completing the AI Act's phased rollout.
